Terms and Conditions

General

Principle Engineering Limited and it’s Customer agree the terms and conditions identified within this document shall govern exclusively the sale by Principle Engineering of all hardware and services (collectively referred to as goods) no addition or alteration of these terms and conditions shall be binding upon Principle Engineering unless authorised in writing and signed by a representative of Principle Engineering.

Terms

Payment of all goods must be made in full before the goods will be shipped unless special credit terms are agreed and signed for by a representative of Principle Engineering.

Delivery

The delivery given either written or verbal is an estimation, which Principle Engineering will endeavour to meet at all times; sometimes things go wrong; in such cases, Principle Engineering will endeavour to inform the customer before the due date and to try and keep inconvenience to a minimum. Principle Engineering cannot and will not accept any consequential damage claims.

Shipment

All prices quoted (including repairs, parts and goods sold separately) are ex‐works. Any shortage should be notified in writing within 7 days of receipt of goods, otherwise Principle Engineering cannot accept responsibility.

Carriage & Packing

All prices listed provide for standard packing for domestic shipping in accordance with Principle Engineering’s standard specifications; if special packing is required, refer to Principle Engineering for additional charges.

Title and Responsibility

Title to hardware shall remain with Principle Engineering as security only and until full payment is received. Risk of loss or damage shall pass to the Customer upon shipment from Principle Engineering’s supplier/point of manufacture/factory.

Product Changes

Changes in design with improvements in manufacture are constantly being made by our suppliers whenever they believe that the product will be improved; Principle Engineering is under no obligation to incorporate these changes retrospectively.

Shipping Weights and Dimensions

Published weights are careful estimates but are not warranted. Dimensions shown in catalogues are approximate.

Quotations

All written quotations automatically expire unless accepted within thirty (30) days from the date quoted; verbal quotations expire on the same day that they are made.

Taxes

The Customer shall pay all excise or similar taxes to the appropriate agency where and when applicable.

Delay

Principle Engineering shall not be liable for damages as a result of any delay due to any cause beyond Principle Engineering’s reasonable control including without limitation, any act of God, act of war or riot, delay in transportation or inability to obtain necessary labour, materials, or manufacturing facilities. In the event of any such delay, the date of delivery shall be extended for a period equal to time lost by reason of delay.

Limitation of Liability

In no event shall Principle Engineering be liable to consequential or incidental damages or any expense incurred by the Customer attributed to any product sold hereunder.

Penalty Clauses

No contracts or quotations showing penalty clause for failure to meet shipment are acceptable to Principle Engineering.

Warranty

1. Our products are warranted by our suppliers against defects in materials and workmanship and to meet the performance specifications as listed in the current catalogue.

1a. During the warranty period, Principle Engineering will, at it’s sole discretion, repair or replace, products which prove to be defective, provided the defect or failure is not due to misuse or abuse of the product; in this case there will be no extra charge to the customer.

1b. Any unauthorised attempt to repair or modify the product(s) will cause this warranty to become null and void. In addition, this warranty does not apply to products that have been subjected to abuse or operated in environments that exceed the design specifications.

2. The goods in question must be returned to Principle Engineering suitably packed, they must include the document history; the product label must be intact.

3. Once received by Principle Engineering the goods will be inspected by the manufacturer, provided the product meets the criteria set out above a replacement or repaired unit will be despatched with the minimum of delay. If it is felt that the unit does not meet the warranty criteria the cost of repair or replacement will be discussed with the customer.

4. Satisfaction of this warranty is limited to the repair or replacement of the product.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES WHETHER EXPRESSED IMPLIED OR STATUTORY

Returns

Goods that have been either over ordered or incorrectly ordered are the responsibility of the customer. In such instances the customer should discuss this with a member of Principle Engineering to explore the possibility of a mutual resolution; it is the intension of Principle Engineering to help where possible but if goods cannot be re‐sold or if they are in anyway damaged they may not be returnable.
